1. Acknowledgment and Assumption of Risk
I, the undersigned (or the parent/guardian of the minor participant), understand and acknowledge that participating in PT Sports Camp involves inherent risks. These activities may include, but are not limited to: running, jumping, throwing, catching, collisions with other participants, or contact with sports equipment. Despite careful and proper preparation, instruction, and supervision, there is still a risk of serious injury—both known and unknown—to myself (or my child).
I acknowledge that these risks could include, but are not limited to, physical injury, emotional distress, property damage, or other serious injuries. I knowingly and freely assume these risks, both known and unknown, even if arising from the negligence of the Releasees (defined below), and assume full responsibility for my (or my child’s participation.
2. Release of Liability:
In consideration of the participant being allowed to participate in PT Sports Camp, I hereby, on behalf of myself (or my minor child), my heirs, personal representatives, and assigns, release, waive, discharge, and covenant not to sue PT Sports Camp, its organizers, directors, officers, employees, volunteers, agents, sponsors, and any affiliated entities (collectively, the “Releasees”) from liability for any and all claims, demands, damages, causes of action, or suits of any kind, including but not limited to personal injury, property damage, or wrongful death, that may occur as a result of participation in the camp activities.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees against any and all claims, demands, damages, costs, expenses (including reasonable attorneys’ fees), or liability arising out of or resulting from my (or my child’s) participation in any camp activities. This indemnification obligation specifically includes claims or causes of action arising out of or related to the Releasees’ own negligence.
4. Medical Authorization
I consent to any emergency medical treatment deemed necessary by appropriate medical personnel in the event of accident, illness, or injury. I understand that I am (or my child is) responsible for any and all medical expenses that may result from accidental injuries during the camp.
5. Governing Law and Severability
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. If any provision of this Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of the remaining provisions of this Agreement, which shall remain in full force and effect.
6. Entire Agreement
This Agreement constitutes the entire agreement between me and PT Sports Camp concerning liability and supersedes any prior or contemporaneous understanding or agreements. No oral representations, statements, or inducements apart from this Agreement have been made.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
